If you are involved in building work requiring excavation, piling, demolition, underpinning, or simply digging foundation trenches for a project, there is always the risk of causing damage to adjoining or nearby property. Even when the cause is outside of your control, perhaps because of the natural characteristics of the location, you could nevertheless find yourself liable for the damage that results. Not only could this leave you exposed to a large financial problem, the building work itself could suffer a considerable setback.
It is important to note that a public liability insurance policy only affords you protection where the damage has been caused by negligence, and not where you have carried out work in a perfectly proper manner. If you do require protection against liability for damage to neighbouring properties, even where you are employing contractors and sub-contractors to do the work for you, JCT Clause 21.2.1 insurance will cover you.
It is often the case that any damage caused by works involving some form of excavation is significant, and therefore any compensation due could be considerable. In view of this, architects, surveyors or consulting engineers may specify JCT Clause 21.2.1 insurance as a requirement of a contract before signing it off.
